A New York state appeals court docket on Tuesday dismissed point out Lawyer Normal Letitia James’ lawsuit accusing Amazon of failing to sufficiently secure thousands of workers at two New York Metropolis amenities towards COVID-19.
The Appellate Division in Manhattan said federal legislation preempted James’ claims that Amazon violated point out labor regulation by retaliating from workers who protested versus unsafe conditions.
It also claimed James’ hard work to require Amazon to comply with point out COVID-19 place of work pointers was moot, mainly because the point out has withdrawn the steerage that she sought to implement.
Neither the lawyer general’s workplace nor Amazon immediately responded to requests for comment.
James had sued Amazon in February 2021 above its alleged failure to supply ample wellbeing and security protections to workers at its JFK8 fulfillment heart in Staten Island and DBK1 distribution heart in Queens, both equally in New York City.
A condition demo judge rejected Amazon’s bid to dismiss the case in Oct.
But the appeals courtroom reported protests from unsafe operating disorders “relate to the workers’ participation in concerted activities for the reason of … mutual support or protection,” and were being secured activity under the Nationwide Labor Relations Act.
It also reported the ruling could article a “substantial danger of interference” with the Nationwide Labor Relations Board, which is considering in essence the similar allegations of retaliation.
